1. Agreement
These Terms and Conditions ("Terms") govern your access to and use of the Swift Start mobile and web application (the "Service"), provided by RoundUp LLC, which operates the Service under the Swift Start brand ("Swift Start," "we," "us," "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
"You" means the center, organization, parent, guardian, or staff member using the Service. If you are accessing the Service on behalf of a center, you represent that you have authority to bind that center to these Terms.
2. Eligibility and accounts
- You must be at least 18 years old to create an account. Children do not create accounts; parents and staff act on their behalf.
- Accounts are created by invitation from a center or by an authorized administrator. Self-serve signup is not offered.
- You are responsible for keeping your credentials secure and for all activity under your account.
- You must notify us immediately at security@roundupece.com if you suspect unauthorized access.
3. The Service
Swift Start provides childcare management tools, which may include attendance check-in/out, daily reports, photo and message sharing between families and staff, developmental observations, incident reporting, classroom and ratio monitoring, and tuition billing. Features available to you depend on your role (parent, teacher, director, or administrator) and on what your center has enabled.
4. Parent and guardian responsibilities
- You confirm you are the parent or legal guardian of any child whose information you provide, and that the information is accurate.
- You are responsible for keeping emergency contacts, pickup authorizations, allergies, and health information current.
- You control your child's media and communication permissions through the app and may change them at any time.
5. Fees and billing
- Where the Service is used to collect tuition or other in-app payments, payment processing is handled by Stripe at standard Stripe rates.
- You authorize charges to the payment method you provide for amounts your center bills through the Service.
- Subscription fees charged to centers (if applicable) are billed in advance per the plan selected, and are non-refundable except as expressly required by these Terms or applicable law.
- We may adjust subscription pricing with at least 60 days' written notice; changes take effect on the next renewal.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of child-care licensing requirements.
- Upload content that is unlawful, harmful, or that you do not have the right to share.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Resell, sublicense, or white-label the Service without a separate written agreement.
- Upload malicious code, attempt to bypass authentication, or otherwise interfere with the Service.
- Use the Service to send unsolicited communications outside the legitimate child-care relationship.
7. SMS / text messaging
If you opt into SMS, you consent to receive text messages (such as check-in/out, daily updates, and billing reminders) at the number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent to SMS is not a condition of using the Service. Full SMS terms are posted at https://portal.swiftstart.education/sms-terms/.
8. Data ownership
- Families and centers own the data they enter into the Service ("Customer Data").
- We act as a data processor for Customer Data, on your instructions, as described in the Privacy Policy.
- We will provide an export of your data on request, as described in the Privacy Policy.
- We retain a non-exclusive license to use Customer Data only as needed to operate the Service for you.
9. Intellectual property
The Service, including its software, design, and branding, is owned by RoundUp LLC and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content you upload.
10. Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. Scheduled maintenance is announced in advance where possible. Centers under a written agreement receive the service-level terms set out in that agreement.
11. Termination
- You may stop using the Service at any time. Parents who wish to remove their account may do so from Settings or by contacting their center.
- A center may revoke access for staff or families it administers.
- We may suspend or terminate accounts that materially breach these Terms, with notice where reasonably possible.
- On termination, data export and deletion follow the schedule described in the Privacy Policy.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." We disclaim implied warranties to the maximum extent permitted by law. The Service supports — but does not replace — your center's professional judgment and supervision of children.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms is limited to the amount you paid us (if any) in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot lawfully be limited.
13. Indemnification
You agree to indemnify and hold RoundUp LLC harmless from claims arising out of your misuse of the Service or your violation of these Terms or of applicable law, to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Multnomah County, Oregon.
15. Changes to these Terms
We may update these Terms from time to time. Material changes are announced at least 30 days before they take effect, through the app and at https://roundupece.com/swiftstart-terms/. The "Last updated" date always reflects the current version. Continuing to use the Service after a change means you accept the updated Terms.
